TERMS OF USE

The use of www.borealist.com ("Borealist") is governed by certain terms of use, which are contained below. If you do not abide by the terms and conditions steps will be taken to suspend your account, remove you from the site or, in some cases, contact the authorities and appropriate regulators. The terms of use are as follows:
  1. Posting. You agree to post items that are tangible in nature and you will only post items that may be legally sold in Canada on the understanding that Borealist will release user information to the authorities in the event that a posted item is determined to be regulated so as to prevent the legal sale through Borealist. The same steps will be taken should it be found that an item posted has been stolen or is counterfeit and is being sold through Borealist.

  2. Grant of Licence of Use. By posting content to Borealist you are granting a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party's rights.

  3. Limit Of Liability. You will not hold Borealist liable, nor does Borealist accept any liability, for any posts by users. Borealist does not guarantee the accuracy of postings or user communications or the quality, safety, or legality of items offered for sale on Borealist. In relation to any 'sales of goods legislation', consumer protection legislation or any other such legislation or regulation covering sale of goods or liability of purchasers Borealist expressly disclaims all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. Borealist will not be held liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Borelaist, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Despite this section in the event that Borealist is found liable, such liability will be limited to $50 Canadian Dollars.

  4. Lotteries or Chance. Borealist does not allow the listing of items to be sold be chance or by lottery. Should such a posting be found the user will be removed from Borealist, and Borealist does not accept responsibility or liability for any such post. This includes raffles, give-aways or skill testing questions paid for by users that result in one user receiving a prize or reward that is not commiserate with the price paid.

  5. Borealist Copyright. You agree not to infringe the Borealist copyright or trademark by copying and distributing any portion of Borealist in any format.

  6. Change in Billing. In the event that you choose to use a 'fee-for-service' portion of Borealist, we reserve the right to make changes to the monthly amount billed, and then bill you for the changed amount, on the condition that we will provide you with two weeks notification of the change in billing during which period you may cancel your account.

  7. Deletion of Posts and Removal from Borealist. If you do any of the following your post will be removed, you may be subject to removal from Borealist and, in certain cases, the authorities will be contacted:
    (a) posting of any profanities, hate language or any statement deemed inappropriate by Borealist. Inappropriate statements will include the inclusion of political views, commentary outside of the description of the item or listing or announcements of events unrelated to the item or listing;
    (b) duplicate postings or postings in such a way as to have multiple postings of one item or listing;
    (c) post false or misleading statements concerning goods for sale, or posts with no item accompanying the listing.;
    (d) copyright infringement or trademark violation. Such infringement include the likenesses of individuals without their approval, autographs, designer labels or bootleg recordings and Borealist will remove any posting that is identified as a violation of copyright or trademark;
    (e) distribute viruses or spam;
    (f) copy, modify, or distribute content or Borealist copyright; and
    (g) collection and distribution of any personal or private information available through Borealist;

  8. Personal Information. You agree to provide Borealist with your correct name, address and current contact information. By using Borealist you agree to the collection, transfer, storage and use of your personal information on servers located in and around North America. Borealist will abide by the applicable privacy legislation in any dealing with said information. You agree that in the event of any violation of paragraphs 1 or 7 you waive any privacy any that your personal information, despite any privacy acts, will be forwarded to the proper authorities.

  9. General. By using Borealist you agree to adhere to the jurisdiction of the Courts of the Yukon Territory

  10. Reporting of Policy Violations. Please alert our offices to any violations of our policies by sending an email to admin@borealist.com. We will review promptly and address you concern on a priority basis.
